The petitioner apprehends his arrest in Narpataganj P.S. Case No. 564 of 2020, registered for the offences punishable under Sections 409, 420 of the Indian Penal Code and section 7 of the Essential Commodities Act. Prosecution case in brief is that one truck was seized loaded with 68 bags of rice each of 50 KG. It is suspected that the same was going to be sold out in black market. It is submitted that petitioner is not named in the FIR and only on suspicion, petitioner has been made accused in this case during course of investigation. Petitioner is a PDS dealer. Without inspection it is alleged that the seized rice belongs to

No person whose statements have been recorded by the informant has stated that the seized food grains are of the petitioner. Petitioner claims clean antecedents. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divsiional Judicail Magistrate, Araria in connection with Narpataganj P.S. Case No. 564 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
