The petitioner seeks bail in connection with Special Case No.7565/2017, arising out of Pipra P.S. Case No.71/2017 registered under Sections 147, 148, 149, 341, 323, 307, 324, 353, 337, 338, 332, 333, 504 of Indian Penal Code, Sections 30(a)/45 of Bihar Prohibition and Excise Act, 2016 and Section 27 of Arms Act.
Five liters of country made liquor is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner has been
Patna High Court Cr.Misc. No.7839 of 2018 (2) dt.13-02-2018 2/2 falsely implicated in this case. The petitioner has got no criminal antecedent. He has been languishing in custody since 20.11.2017. Similarly situated co-accused namely Lalu Kumar @ Lallu Kumar, Loulesh @ Laulesh Manjhi and Laxman Ravidas @ Lakshman Ravidas have been enlarged on bail by co-ordinate Bench of this Court vide orders dated 30.01.2018 and 23.01.2018 respectively.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No.7565/2017, arising out of Pipra P.S.
