2. Petitioner apprehends his arrest in a case registered for the offence punishable under sections 25 (1-b)/a/26/35 of Arms Act.
3 . The prosecution case in brief, is that on secret information, a raid was conducted at the spot where 2 accused persons were apprehended and recovery of a loaded country made pistol and live cartridge was made and the apprehended accused persons disclosed the name of this petitioner as one of the associates.
4. It is submitted on behalf of the petitioners that petitioner is innocent and has committed no offence as alleged. The name of the petitioner transpired during course of
Patna High Court CR. MISC. No.47885 of 2025(2) dt.05-08-2025 2/2 investigation on confessional statement of co-accused persons. Except confessional statement there is nothing on record to show the complicity of this petitioner in the aforesaid alleged occurrence . No incriminating article has been recovered from possession of petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposed the bail petition .
6 Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned JM 1st Class Bhojpur at Ara in connection with Bahoranpur P.S. Case No. 45 of 2025 , subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita , 2023 . (Prabhat Kumar Singh, J) Koushik/- U T
