====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-08-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Motipur P.S. Case No. 134 of 2019, registered under Section 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The accusation is that in the evening of 17.03.2019 petitioner informed on mobile to the informant for doing mediation to settle the family dispute. Thereafter, informant reached at the house of petitioner at village Sinduariganj, where Jitendra Bhagat, his father, Jiyalal Bhagal, Premchand Paswan and his father Arun Paswan were present. On hearing, matter was pacified. Thereafter, informant started to move from there

Patna High Court CR. MISC. No.49049 of 2019(2) dt.06-08-2019 2/2 then Jitendra Bhagat and Premchandra Paswan shot fire at the back of the informant, who fell down.

Learned counsel for the petitioner submits that, in fact, petitioner called the informant for Panchayati and after Panchayati when the informant started to move from there then Jitendra Bhagat and Premchandra Paswan shot fire at the back of informant and petitioner has no role in the alleged crime but he has been implicated in the present case mere on suspicion. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Muzaffarpur, in connection with Motipur P.S. Case No. 134 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
