JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court in Cr.Misc. No. 8045 of 2017, vide order dated 23.2.2017 with direction to learned trial court to conclude trial within a period of six months and if not concluded the petitioner was given liberty to renew his prayer for bail in the court below. Submission of learned counsel for the petitioner is that period of six months has already expired and only charge has been framed and there is no likelihood of conclusion of trial in near future and co-accused has been granted bail by this Court in Cr.Misc.No. 55141 of 2017, vide order dated 15.11.2017 and petitioner is in custody in this case since 21.9.2016. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.5675 of 2018 (2) dt.08-02-2018 2/2 circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Chief Judicial Magistrate, East Champaran, Motihari, in connection with Trial No. 1943 of 2016, arising out of Motihari Town P.S.Case No. 561 of 2016, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in trial and appear before the court below as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
