====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-12-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offence punishable under Section 302/34 of the Indian Penal Code.

As per the prosecution case on 19.02.2022, all the accused persons named in the F.I.R., including these petitioners, committed murder of the sister of the informant by strangulation. It is further alleged that when informant with his family members reached the house of his in-laws, they found the dead body of his sister was lying at the door and the accused persons

Patna High Court CR. MISC. No.50122 of 2022(2) dt.15-12-2022 2/2 were fled away.

Petitioner no. 1 is father-in-law, petitioner no. 2 is mother-in-law and petitioner-no. 3 is bhagini of the husband of the deceased.

There is general and omnibus allegation against the petitioners. They are victims of over implications. Petitioners are living separately since last several years, they have got no concern with family affairs of the deceased and her husband. Husband of the deceased is already in custody. Learned counsel appearing for the State vehemently opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Bettiah, District-West Champaran in connection with Lauriya P.S. Case No. 47 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
