====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 20-09-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Excise Act.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and seeks bail on parity as co-accused Ranjit Kumar and Chandan Kumar have been granted anticipatory bail by order dated 22.11.2021 in Criminal Miscellaneous No. 37658 of 2021 and order dated 15.04.2021 in Criminal Miscellaneous No. 37019 of 2020 respectively. It is submitted that Chandan and the petitioner are brothers. Learned counsel next submits that petitioner does not

Patna High Court CR. MISC. No.49630 of 2022(2) dt.20-09-2022 2/2 stay in his house and stays outside for his livelihood and came to be implicated when he had come during his holiday. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 1,000/- (Rupees One Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Saraiya P.S. Case No. 72 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
