This application for grant of regular bail arises out of Ara Town P.S. Case No. 115 of 2015, disclosing offence under Section 392 of the Indian Penal Code.
The petitioner was not named in the First Information Report. As per the prosecution case, the miscreants had snatched golden rings, chain, mobile phone, PAN Card and some cash from the informant.
It is submitted on behalf of the petitioner that he was taken into custody on the basis of mere suspicion. He is in custody since 16.05.2015 and allegedly he has made confessional statement before the Police. He submits that over and above, the
Patna High Court Cr.Misc. No.47603 of 2015 (2) dt.04-11-2015 2/2 confessional statement, allegedly, made by the petitioner before the Police in course of investigation, there is no material against him to connect him with the said occurrence. Neither any recovery has been made from petitioner nor he has been put on T.I. Parade so far.
Considering the submission as above and the incarceration, this application is allowed.
Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Town P.S. Case No. 115 of 2015.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
