The petitioners seek a direction to the respondents to grant full scholarship/assistance to the petitioners who are students of B.Tech Courses at Sityog Institute of Technology, Aurangabad under the Centrally sponsored scheme of PostMatric Scholarship for students belonging to scheduled castes and provide full fees and other expenses covered under the said scheme.

It appears that the case of the petitioners is squarely covered by a decision of this Court rendered on 15.12. 2016 passed in CWJC No. 11305 of 2016 ( Pawan Kumar and others vs. State of Bihar and ors), wherein this Court had the occasion to consider a circular dated 16.05.2016 issued by the State of Bihar. The Court has specifically held that the said circular will have only prospective effect and will have no application for the financial year 2015-16 and the previous academic session. The said decision has subsequently been followed by this Court in case of Nakul Kumar and ors. vs. State of Bihar & ors passed in CWJC No. 7778 of 2017 by order dated 19.01.2018.

4. This application also stands disposed of in terms of the direction of this Court in case of Pawan Kumar and ors. Vs. State of Bihar and ors, passed in CWJC No. 11305 of 2016 and Nakul Kumar and ors Vs. State of Bihar and ors, passed in CWJC No. 7778 of 2017.

5. The State respondents are directed to release the scholarship forthwith, accordingly.
