The petitioner seeks bail in a case instituted for the offences under Sections 307/506 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused person opened fire at the son of the informant due to which he sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.6.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The occurrence is said to have taken place on 9.5.2018 and the case was instituted on 24.5.2018. The delay in lodging the case has not been explained.

Patna High Court CR. MISC. No.49144 of 2019(2) dt.06-08-2019 2/2 General and omnibus allegation has been made against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Malaypur P.S. Case No. 38/2018.
