2. Having regard to the fact that this Court had never issued any positive direction for promoting the petitioner and the limited direction in the connected writ application was only to consider the case of the petitioner for grant of benefit of A.C.P. and in compliance of the same the authorities have examined the matter and have come out with a reasoned order holding that the petitioner will not be entitled for grant of ACP on account of his not passing the departmental examination, there will be no need now to continue with the proceedings this contempt proceeding inasmuch as the opposite parties have complied the order of this Court in letter and spirit by passing a reasoned order.
Patna High Court MJC No.2717 of 2014 (2) dt.13-07-2015 2/2
3. Nonetheless, if the petitioner has some evidence to show that he had actually passed both the parts of the departmental examination, he can still approach the authorities to satisfy them that he was/is entitled for grant of ACP.
4.
With the aforementioned observation, this application is disposed of.
