2. The petitioner is apprehending his arrest in Paharpur P.S. Case No. 166 of 2023 registered under Sections 302, 201, 34 of the IPC, 1860.

3. As per the prosecution story, on account of trivial issue, the husband of the informant assaulted her (the informant), and the informant went to hospital for treatment. Further allegation is that, when she returned her house, she found her husband missing and the petitioner acknowledged her that her husband has committed suicide and the corpus of her husband has been hidden.

4. Learned counsel for the petitioner has submitted that the

He has further submitted that it is an admitted fact that there was a quarrel between the husband and wife and the deceased (husband) has committed suicide by strangulating himself. So far as, the petitioner is concerned, there is allegation against him that he along with a co-accused persons concealed the dead body of the deceased (husband of the informant).

5. On the other hand, learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

6. The deceased has committed suicide because of quarrel between the deceased and his wife and the allegation against the petitioner is of assisting the co-accused persons in concealing the dead body of the deceased.

7. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, East Champaran, Motihari in connection with Paharpur P.S. Case No. 166 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure/ 482(2) of the

8. It is made clear that the petitioner will appear in the court below on each and every date fixed in the case till framing of charge.
