The petitioner, already in custody, seeks bail in connection with Spl. Case No. 31 of 2017 arising out of Jogbani P.S.Case No. 201 of 2017 registered under Sections 8 and 20B of the N.D.P.S.Act.

Allegation in brief is that police raided the house of one Afzal @ Rahmat and three persons escaped away but Afzal @ Rahmat apprehended and from him 110 grams Ganja was recovered.

Submission is that there is no recovery of any narcotic material from the possession of the petitioner and he is only alleged to have escaped away when the police arrived at the house of Afzal @ Rahmat and he has no criminal antecedent, except one case of under Sections 307, 386 and other allied

Patna High Court Cr.Misc. No.21683 of 2018(2) dt.13-04-2018 2/2 offences of penal code, no any other case of N.D.P.S.Act. Having considered the aforesaid facts and circumstances, the petitioner, namely , Imaran @ Alam @ Imran Alam, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Araria in connection with Spl. Case No. 31 of 2017 arising out of Jogbani P.S. Case No. 201 of 2017.
