The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 304(B), 120(B), 201, 34 of the Indian Penal Code.

Allegation against the petitioners is that they killed informant's daughter by giving poison thereafter cremated her body.

Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Petitioners are father-in-law and mother-in-law of the deceased due to which they have falsely been made accused in this

Patna High Court CR. MISC. No.49569 of 2022(3) dt.11-01-2023 2/2 present case. It is further submitted that they have no concern mess and business with the deceased and her husband. It is further submitted that the husband of the deceased is already been judicial custody. They have got no criminal antecedent. The petitioners are languishing in judicial custody since 18.6.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Rafiganj P.S. Case No. 159 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad.
