In this case, the petitioner is seeking bail in connection with Kinjar P.S. Case No. 21 of 2015 registered for offence under section 302 of the Indian Penal Code. As per the allegation, the marriage has taken place 10 years back. The deceased was in the in-laws' house there he died. His brother has made a statement before the Police that the petitioner for certain reason, has picked up quarrel and there the victim was assaulted and died.

The counsel for the petitioner submits that the real fact is otherwise, as the victim died on account of fall in drunken condition from the roof of the house, for that, he has drawn

Patna High Court Cr.Misc. No.49281 of 2015 (2) dt.04-11-2015 2/2 attention to the order relating to Anisha Khatoon and Chando Begam passed in Cr. Misc. No. 22982 of 2015 where the Court has seen the case diary and recorded that the deceased in a drunken stage, had jumped from the roof of the house and subsequently he died. He further submits that after his fall, he was brought to Patna for treatment and there the Doctor has recorded that he was in a drunken condition.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal in connection with Kinjar P.S. Case No. 21 of 2015.
