JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Nathnagar P.S. Case No. 148 of 2013 registered for the offences punishable under Sections 25(1-b)A, 26 and 35 of the Arms Act. Allegedly, acting on a tip off, a raid was conducted and on search being made cartridges and pistols were recovered from the persons arrested on the spot and from the vehicle driving license and identity proof of the petitioner was seized. The petitioner is said to be the driver of the vehicle in question.

In view of the aforesaid facts, this Court is not

Patna High Court Cr.Misc. No.29712 of 2014 (2) dt.13-01-2015 persuaded to grant privilege of pre-arrest bail to the petitioner, accordingly, his such prayer stands rejected. However, in case and if so advised, the petitioner surrenders and seeks regular bail before the court below, then his prayer shall be considered on its own merit without being prejudiced by the present order.
