JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 341, 323, 354(B), 504 of the Indian Penal Code.
The prosecution case is that the petitioner entered into the house of informant on 03.10.2015 at 8 PM and assaulted her mother, tried to kill her, made her nude and threatened to kill other family members.
It is submitted by the learned counsel for the petitioner that in the background of Title Suit No. 19/2008 pending between the parties, the accusation has been made. The petitioner is about 70 years old. Statement has been made in paragraph 3 of the
Patna High Court Cr.Misc. No.2654 of 2016 (3) dt.27-01-2016 2/2 supplementary affidavit that in Ben P.S. case No. 54/2013 the petitioner is on bail.
Considering the fact that the accusation has been labelled in the backdrop of litigating relationship between the parties, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Nalanda at Biharsharif in connection with Ben P.S. Case No. 116/2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
