2. The petitioner seeks regular bail in connection with Bahadurpur P.S. Case No.79 of 2023 registered for the offences punishable under Sections 304(B) & 34 of the Indian Penal Code.

3. As per the prosecution case, the sister of the informant was murdered by the co-accused Manju Devi @ Bachiya Devi and Vishal Ranjan who are mother and brother of the petitioner, respectively.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that in the fard beyan of the informant, there is no allegation against the petitioner and it was stated that the victim died due to hanging. The informant and petitioner

Patna High Court CR. MISC. No.56944 of 2024(7) dt.20-12-2024 2/2 both were present during the treatment of the victim and during the treatment, the victim had died. The victim was suffering from mental illness. The name of the petitioner came in this case in the statement of the informant recorded under Section 161 of Cr.P.C. in which there is no specific allegation against the petitioner. The petitioner is in jail custody since 29.03.2023. The petitioner has no criminal antecedent and as per the status report, charge-sheet has already been submitted against the petitioner in this case. Petitioner undertakes to co-operate in the trial.

5. Learned APP for the State has opposed the prayer of the petitioner for bail.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate Ist Class, Patna City / Concerned Court in connection with Bahadurpur P.S.
