====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 26-09-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are seeking anticipatory bail in connection with Vaishali (O.P. Belsar) P.S. Case No. 66 of 2019 registered under Sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the injury caused on the body of the informant and his brother are simple in nature caused by hard and blunt substance and there is no injury caused by Garasa and Sword as has been alleged by the informant. Learned counsel submits that there is a case and counter case and these petitioners have no criminal antecedent. Learned A.P.P. for the State has opposed the prayer for
Patna High Court CR. MISC. No.46164 of 2019(3) dt.26-09-2019 2/2 anticipatory bail of the petitioners.
Considering the facts and circumstances of the case from which it appears that the injuries caused on the body of the informant and his brother are simple in nature caused by hard and blunt substance and there is no injury caused by Garasa and Sword as has been alleged by the informant and further that there is a case and counter case and these petitioners have no criminal antecedent, let the petitioners above-named, in the event of his arrest/surrender before the court below within a period of four weeks, be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Vaishali (O.P. Belsar) P.S. Case No. 66 of 2019, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
