The petitioner, in the present case, is seeking regular bail in connection with Paharpur P.S. Case No.77 of 2017, registered for offences alleged under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the FIR, however in course of investigation on the basis of the confessional statement of coaccused Alok Tiwary and Md.Shahid Alam @ Dabloo Mian this petitioner has been involved in the present case. Submission is that the co-accused who had allegedly killed the son of informant and made statement that this petitioner had also participated along with

Patna High Court Cr.Misc. No.4905 of 2018 (2) dt.02-02-2018 them have been granted regular bail by different coordinate Benches of this Court in Cr.Misc.No.497 of 2018 as also Cr.Misc.No.40652 of 2017. It is further submitted that there are three cases against the petitioner as stated in paragraph 3 of the application, however in all the cases he is on bail. Submission is that the petitioner has falsely been implicated in this case and no substantial material has come against him.

Learned counsel for the State is present and opposed the prayer for bail.

However, in the facts and circumstances of the case where the co-accused on whose statement name of this petitioner has been involved in this case have already been granted regular bail by different coordinate benches of this Court, I am inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail, if not wanted in any other case, on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., East Champaran, Motihari in connection with Paharpur P.S.
