JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-07-2019 This application, for grant of anticipatory bail, arises out of Barharia P.S. Case No. 147 of 2019, disclosing offences under Sections 341, 323, 324, 308, 427, 379, 504 of the Indian Penal Code.
Allegation as per F.I.R. is that while the Barat for the marriage of daughter of the informant had come, the petitioner came and started abusing and destroyed chairs, tables and other articles and when the son in law intervened in the matter, he was stabbed by the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case as earlier the cousin of the petitioner has lodged a case against the informant. Furthermore, the impugned order itself shows that the statement of injured has not been recorded and there is no injury report

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Barharia P.S. Case No. 147 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
