The petitioner has preferred this application for grant of regular bail in a case registered under sections 8, 20(b)(ii)(c) and 27A of the NDPS Act.

As per the prosecution case, on a raid being conducted 24 kgs of ganja was recovered. The petitioner was absconding. Coaccused Baban Singh, Akhilesh Ram and Dina Kumar were taken into custody.

It is submitted by learned counsel for the petitioner that from perusal of the FIR itself, the petitioner was not arrested at the spot. Amongst the accused who were arrested at the spot Akhilesh Ram has been enlarged on bail vide order dated 16.12.2020 passed in Cr.Misc. no. 30711 of 2020 and Dina Kumar has been enlarged on bail vide order dated 20.10.2020 passed in Cr.Misc.no. 27152 of

Patna High Court CR. MISC. No.60734 of 2021(2) dt.11-04-2022 2/2 2020. Neither the petitioner was arrested at the spot nor any incriminating article has been recovered from his possession. He is in custody since 21.8.2021 and has no criminal antecedent. Charge sheet has been submitted in the case.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner not having any criminal antecedent, not having arrested at the spot and grant of bail to the above named two accused persons, the petitioner is directed to be enlarged on bail in connection with Bhagwanpur P.S.Case 66 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III -cum-Special Judge, Kaimur, Bhabua.
