2. The petitioner is in custody in connection with Pakaridayal P.S Case No. 15 of 2023 registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.

3. As per allegation in the FIR, petitioner along with other accused persons have assaulted the informant's father and during treatment he died.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that allegation against the petitioner is of general and omnibus in nature. It would be apparent from the complaint itself that the informant got knowledge about the incident on

Patna High Court CR. MISC. No.48577 of 2025(3) dt.15-10-2025 2/2 08.10.2022 itself and yet he filed the present complaint on 28.11.2022 and the delay has not be explained. It is also submitted that petitioner is in judicial custody since 11.04.2025 having clean antecedent.

5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.

6. On perusal of the FIR and impugned order dated 09.06.2025, it appears that after the alleged occurrence, panchayati had been convened and it was stated that an amount of Rs. Lakhs would be given to the brother of the deceased and since that money was not given and for this reason, the present case has been lodged. So, considering the aforesaid facts and circumstances of the case and submissions made on behalf of the learned counsel for the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-8 Motihari, East Champaran in connection with Pakaridayal P.S. Case No. 15 of 2023.
