The petitioner seeks bail in Baniyapur P.S. Case No. 67 of 2014, registered for the offences punishable under 302, 120(B) and 34 of the Indian Penal Code and section 27 of the Arms Act.

Petitioner and co-accused Rabindra Kunwar are alleged to have made indiscriminate firing upon the son of informant, as a result of which he died on the spot. Earlier vide order dated 13.08.2019, report regarding stage of trial was called for, which has already been received vide letter no. 199 dated 30.08.2019. From perusal of report, it appears that charge has already been framed on 21.08.2019 and summons to witnesses have been issued on 29.08.2019. Seven

Patna High Court CR. MISC. No.50108 of 2019(4) dt.06-11-2019 2/2 witnesses are to be examined and around six months is required for conclusion of trial.

Considering the facts aforesaid and the fact that there is specific allegation against this petitioner, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.

The trial court is directed to conclude the trial within a period of one year from today.
