JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17.02.2016 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Taking into consideration that petitioner happens to be the main assailant, I am not inclined to release him on bail and hence, his prayer for bail in connection with Koilwar P.S. Case no. 119/2014 is, again, rejected.

Learned Chief Judicial Magistrate, Bhojpur at Ara has reported vide letter no. 264/16 dated 10.2.2016 that due to nonappearance of co-accused Bipin Singh, case of the petitioner could not be committed to the court of sessions and moreover, case record has already been transferred to Addl. Chief Judicial Magistrate VII, Ara. In the aforesaid circumstance, Addl. Chief Judicial Magistrate VII, Ara/ concerned court is directed to commit the case of the petitioner to the court of sessions within two weeks in accordance with law from the date of receipt/production of a copy of this order
