The petitioner, who is in custody, seeks bail in connection with Vigilance P.S. Case No. 88 of 2017 corresponding to Spl. Case No. 35 of 2017 registered for the offence punishable under Sections 7/13(2) read with Section 13(1) (d) of P.C. Act, 1988.
Complaint was filed by Ravikesh Pandey before the Officerin-Charge, Vigilance Bureau Patna on 04.10.2017 in which it has been stated that the accused petitioner was demanding Rs. 10,000/- as a bribe for issueing rent receipt of his land but he was not ready to give said bribe and thereafter FIR was lodged and accused petitioner was caught red handed accepting 5000/-
Patna High Court Cr.Misc. No.4351 of 2018(2) dt.09-02-2018 2/2 bribe from the said Ravikesh Pandey (Complainant). Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. The complaint on which proceedings has been drawn is also incorrect and he had already issued the rent receipt in favour of the petitioner much prior to the said trap case. It has been submitted that petitioner has no criminal antecedent and he is in custody since 02.11.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance, North Bihar, Muzaffarpur, in connection with Vigilance P.S. Case No. 88 of 2017. corresponding to Spl. Case No. 35 of 2017 (S. Kumar, J) veena/- U T
