The petitioner is aggrieved with the part of Memo No. 1119 dated 30.06.2026 whereby he has been transferred from the post of Head Clerk, Women Industrial Training Institute (ITI), Jehanabad to Industrial Training Institute (ITI), Semra Bazar, Bagaha. The petitioner further seeks a direction upon the respondents to consider his posting as Head Clerk at any establishment situated in or around Patna District, primarily on the ground that he is at the fag end of his service career.

3. It is the petitioner's specific case that several employees junior to him have been accommodated at places near their native districts, whereas his case has not been

The Principal, Women ITI, Jehanabad, taking note of the hardships likely to be faced by the institution as well as the petitioner, has recommended that either the petitioner be retained on the post of Head Clerk at Women ITI, Jehanabad or, in the alternative, be posted on deputation against the said post, particularly when the post is stated to be lying vacant and no incumbent has been posted there till date.

Learned counsel appearing for the petitioner submits that, highlighting the aforesaid facts and circumstances, the petitioner has already submitted a detailed representation before the Director, Directorate of Employment and Training, Bihar, Patna, vide Annexure-P/5 dated 01.07.2026. However, no decision has yet been taken thereon.

5. Learned counsel appearing for the State fairly submits that since the petitioner has already submitted a detailed representation, the competent authority shall consider and dispose of the same in accordance with law.

6. Having regard to the limited grievance raised by the petitioner and without expressing any opinion on the merits of the rival claims, this Court deems it appropriate to dispose of the present writ petition with liberty to the petitioner to file a fresh

Patna High Court CWJC No.10570 of 2026(2) dt.24-07-2026 3/3 representation, enclosing therewith the recommendation of the Principal, within a period of one week from today. If such a representation is filed within the aforesaid period, Respondent No. 3 shall consider and dispose of the same by passing a reasoned and speaking order, preferably within a further period of two weeks thereafter, in accordance with law.

It is expected that, until a final decision is taken on the petitioner's representation, the respondents shall permit the petitioner to continue discharging his duties at his previous place of posting, if no substitute has been posted in his place and if there is no administrative impediment to such an arrangement.

8. With the aforesaid observations and directions, the writ petition stands disposed of.
