2. The petitioner seeks regular bail in connection with Ramgarhwa P.S. Case No. 364 of 2022, registered for the offence punishable under Sections 341, 323, 325, 307, 504, 34 of the Indian Penal Code.

3. As per prosecution, the petitioner and others have assaulted the prosecution side.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner has no criminal antecedent and he is in custody since 03.06.2023.

5. Learned APP has vehemently opposed the prayer

Patna High Court CR. MISC. No.49992 of 2023(2) dt.19-08-2023 2/2 for bail.

6. Considering the aforesaid fact and also the period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in connection with Ramgarhwa P.S. Case No. 364 of 2022.
