JUSTICE PARTHA SARTHY ORAL ORDER 25-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Daudnagar P.S. Case no. 230 of 2020 registered under sections 25 (1-B)(a) and 26 of the Arms Act.

As per allegation in the FIR, a country made pistol was recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no recovery of any incriminating article has taken place from his person or possession. The petitioner is in custody since 7.8.2020, charge sheet has been submitted in the case and he has no criminal antecedent.

The application for bail is opposed by learned APP

Having heard learned counsel for the parties and taking into consideration the period in custody and the petitioner not having any criminal antecedent, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Daudnagar P.S. Case no. 230 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar at Aurangabad.
