JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 29.07.2015 in a case registered under section 376 read with section 511, 354 and 379 of the Indian Penal Code.

The accusation against the petitioner is that he having entered the house of the informant made attempt to commit rape on her but submission on behalf of the petitioner is that the informant is cousin sister-in-law of the petitioner's married sister and as matter of fact, there was partition dispute between the father-in-law of the petitioner's sister as well as father of informant and that is the reason of false institution of the present case.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.46928 of 2015 (2) dt.07-10-2015 2/2 well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in connection with Bariyarpur P.S.Case No. 91 of 2015.
