The petitioner is in custody in a case registered under Sections 25(1-b)a and 26 of Arms Act.

The allegation against the petitioner is that from his possession one double bore country made pistol and one loaded country made pistol and one empty cartridge along with mobile were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 06.05.2015.Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. As per prosecution one loaded country made pistol, one empty cartridge and mobile are said to have been recovered

Patna High Court Cr.Misc. No.37761 of 2015 (3) dt.07-10-2015 2/2 from the possession of the petitioner. The said recovery is denied by the petitioner.

On behalf of the State it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Rohtas at Sasaram in Sasaram (Agrer) P.S.Case No. 498 of 2015.
