JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 439 of the Indian Penal Code.

As per the prosecution case, some unknown miscreants entered the house of the informant, assaulted the informant and his family members, made firing and looted house hold articles.

Learned counsel for the petitioner submits that the petitioner's name has figured during course of investigation in confessional statement of co-accused but petitioner has not been identified in the Test Identification Parade. He is in custody since 21.6.2021. Investigation is complete.

Patna High Court CR. MISC. No.59359 of 2021(2) dt.07-02-2022 2/2 Learned counsel appearing for the State and the informant oppose the prayer for bail and submit that the petitioner has got criminal antecedent.

Considering the aforesaid facts and circumstances of the case and the fact that the petitioner has not been identified in the TI parade, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai in Barauni (FCI OP) Police Station Case No. 134 of 2021.
