Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 324, 307, 379, 354(B), 448, 504 and 506/34 of the Indian Penal Code, registered in connection with Deepnagar P.S.case No. 115 of 2021 (G.R.No. 2152 of 2021).
As per allegation, four named accused persons including the present petitioner entered into the house of the informant and co-accused Akhilesh Mahto and Videsi Mahto
Patna High Court CR. MISC. No.59724 of 2021(2) dt.13-07-2022 2/3 and the present petitioner assaulted the husband of the informant with lathi and rod. Co-accused Akhilesh Mahto outraged the modesty of the informant and he has also taken away Rs. 5000/- from the house of the informant and snatched a gold earring from her ear.
The learned counsel for the petitioner has submitted that the petitioner and the informant are the next-door neighbours. There is land dispute between the parties. The petitioner is a person of clean antecedents and the brother of the informant has lodged a case against the prosecution side. Considering the above facts and circumstances as well as the clean antecedents of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda, Biharshari in connection with Deepnagar P.S.Case No. 115 of 2021 (G.R.No.2152 of 2021), subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided
