The petitioner has been in custody since 12.08.2017 in connection with Balua Bazar (Lalit Gram O.P.) P.S. Case No. 55 of 2017 for the offence registered under Sections 413 and 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that though it is stated in the first information report that the motorcycle in question was recovered from the possession of the petitioner, the seizure list indicates that the motorcycle was recovered near Mirchai Bridge, NH-57 and thus, it is evident that it was not recovered from the possession of the petitioner. Considering the aforesaid facts and circumstances of the case and the period of custody, let the petitioner, above named,

Patna High Court Cr.Misc. No.5673 of 2018 (2) dt.02-02-2018 be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Pratapganj P.S. Case No. 55 of 2017.
