====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 30-08-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner seeks regular bail in connection with Adhaura P. S. Case No. 42/2023 in a case registered for the offences punishable under Section 25(1-aa)/(1-b)a, 26, 35 of Arms Act and Section 13, 18, 19 of the Unlawful Activities (Prevention) Act.

3. As per prosecution case, on secret information, a raid was conducted in the house of co-accused Vijay Shankar Singh where eight country made pistols were recovered.

4. Learned counsel for the petitioner submits that no arms and ammunition has been recovered from possession of the petitioner and he is no way connected with the aforesaid

Patna High Court CR. MISC. No.52160 of 2024(2) dt.30-08-2024 2/2 recovery. Petitioner has been made accused merely on the basis of confessional statement of co-accused Vijay Shankar Singh. Petitioner was remanded in this case on 23.09.2023.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VII, Kaimur at Bhabua in connection with Adhaura P. S. Case No. 42 of 2023 corresponding to S.T. No. 83 of 2024. (Prabhat Kumar Singh, J) Navya/- U T
