1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Bhadaur P.S. Case No. 02 / 2024 dated 08.01.2024 registered for the offence under Section 392 / 34 of the I.P.C.
3. As per the F.I.R. on 08.01.2024 at about 3:04 PM the informant reached at PNB Bhadaur branch on his motorcycle and withdrew Rs. 1,84,000/- from the bank and proceeded towards his house. When he reached near Pokharpar Chauk in the meantime three unknown persons aged about 22-28 years riding on a bike intercepted him and snatched his bag and when he raised protest then two persons pointed out pistol upon him and fled away.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. He next submits that petitioner is not named in the F.I.R. The name of the petitioner has surfaced in this case during course of investigation in the confessional statement of the coaccused / Ravi Kumar. He next submits that no incriminating article and / or looted property has been recovered from the conscious possession or from the house of the petitioner. He also submits that save and except confessional statement of the co-accused there is no material to connect the petitioner with the present case.

Regard being had to the submission made by the petitioner, taking into consideration the fact that in the impugned order the learned Additional Sessions Judge-I, Barh has taken note of the fact that the informant in paragraph no. 03 of the case diary has supported the factum of occurrence, paragraph no. 61 of the case diary contains the supervision note of Sub Divisional Police Officer, Barh, the petitioner has one criminal antecedent and the fact that petitioner's name has surfaced in the confessional statement of the co-accused / Ravi Kumar which may be the basis of further investigation against the petitioner for which custodial interrogation of the petitioner
Patna High Court CR. MISC. No.48078 of 2025(2) dt.11-08-2025 3/3 may be necessary, accordingly I am not inclined to grant anticipatory bail to the petitioner. The same is rejected. (Anil Kumar Sinha, J) praful/- U T
