This is an appeal under Section 14-A(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 25.06.2025 passed by the learned Exclusive Special Judge, S.C./S.T. Act, Patna in connection with Barh P.S. Case No. 305 of 2025 registered for the offences punishable under Sections 126(2), 115(2), 329(3), 74 and 3(5) of the B.N.S. as well as Sections 3(1)(s), 3(1)(r) and 3(2)(va) of the SC/ST Act.
3. The case of the prosecution, in short, is that the

On 07.05.2025 at 7:00 P.M., the appellant being armed with a gun entered in the house of the respondent, started teasing her. It is further alleged that the appellant also poured diesel and petrol over the respondent and tried to torch her. It is further alleged that she was being assaulted as well. In the last part of the F.I.R., it is alleged that the appellant has abused the respondent with caste name and has asked her to vacate the place.
4. Learned counsel for the appellant submits that the appellant has been falsely implicated in the instant case. He is innocent and has committed no offence. He has got no criminal antecedent. From the F.I.R. itself it is clear that the date of occurrence is of 07.05.2025 and the F.I.R. was lodged on 15.05.2025. There is delay of eight days in filing of the F.I.R. and the delay is not explained. It has also been submitted that no injury has been caused to any person. It has also been submitted that there is dispute of way between the parties. Parties are neighbors and the allegation of abusing with caste name was not in public view. The same has been added with a view to aggravate the allegations.
5. Learned Spl. P.P. for the State and learned counsel for the respondent have vehemently opposed the appeal for bail.

6. In view of the submissions made by the learned counsel for the appellant, the order dated 25.06.2025 passed by the learned Exclusive Special Judge, S.C./S.T. Act, Patna in connection with Barh P.S. Case No. 305 of 2025 is hereby set aside and the appellant above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Barh P.S. Case No. 305 of 2025, subject to the conditions as laid down under Section 482 (2) of the BNSS.
7. Accordingly the appeal stands allowed.
