The petitioners seek bail in connection with Sahebganj P.S. Case No. 66 of 2013 registered under Sections 435, 387 read with 34 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.
The prayer for bail of the petitioners was earlier rejected by this Court vide order dated 11.09.2014 passed in Cr. Misc. No. 34720 of 2014 with following observations:- "The learned S.D.J.M., (West), Muzaffarpur is
Patna High Court Cr.Misc. No.44195 of 2015 (2) dt.07-10-2015 2 / 2 directed to hold the trial on day-to-day basis and conclude the same as early as possible preferably within seven months from the date of receipt/production of a copy of this order failing which the petitioners would be entitled to renew their prayer for bail."
It is contended that though the petitioners are in custody since 23.03.2014, till date even charges have not been framed.
Regard being had to the observations made in the order dated 11.09.2014, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. (West), Muzaffarpur in connection with Sahebganj P.S. Case No. 66 of 2013. (Ashwani Kumar Singh, J.) Sanjeet/- U T
