Heard the learned counsel for the petitioner and Mr. Shailendra Kumar, the learned APP for the State. The petitioner apprehends his arrest for the offences alleged under Sections 341, 323, 325, 307, 504, 506 and 34 of the Indian Penal Code, registered in connection with Koilwar P.S.Case No. 234 of 2021.

As per allegation, some altercation took place between the parties regarding drainage of water. The allegation against the petitioner is that he ordered other accused persons to assault. There is also allegation against the petitioner to inflict

Patna High Court CR. MISC. No.61531 of 2021(2) dt.18-07-2022 2/2 assault on the person of the informant and his son. The learned counsel for the petitioner has submitted that he is innocent. There is case and counter case. The petitioner is a person of clean antecedents and the injury suffered by Uttam Kumar is simple in nature, whereas the informant did not suffer any injury.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara in connection with Koilwar P.S.Case No. 234 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
