The petitioners are languishing in jail since 30.05.2015 and 05.07.2015 in a case instituted under Sections 395, 397 and 412 of the Indian Penal Code and Section 4 of the Explosive
Patna High Court Cr.Misc. No.38042 of 2015 (3) dt.07-10-2015 Substance Act.
As per allegation, it is a case of bank dacoity of Gramin Bank, Ghantaghar, Bhagalpur of Rs.49,10,372/- by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner Bipin Kumar is in custody since 30.05.2015 and petitioner Rajendra Kumar Pal @ Rajendra Pal is in custody since 05.07.2015. Chargesheet has been submitted in the case. There is no allegation of tampering with the evidence against the petitioners. Petitioners are not named in the FIR. The only material is the confession of a co-accused.
On behalf of the State, it has been submitted that the petitioners name have come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction learned CJM, Bhagalpur in connection with Kotwali (Adampur) P.S.Case No.318 of 2015, G.R.No.1852 of 2015.
