JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 19-08-2015 Heard the Counsel for the petitioner and the respondents. Tenant of Eviction Suit No. 11 of 2009 has filed the present application aggrieved by the order dated 19.3.2010 whereby the Court directed the petitioner to deposit rent @ Rs. 750/- per month for the period July, 2007 to February, 2010 with certain rider. There is no dispute between the parties that the petitioner earlier vacated the suit premises and possession thereof was given to the plaintiff-landlord. It has been submitted that the Eviction Suit No. 11 of 2009 has already been dismissed by the Trial Court for non-prosecution. The counsel for the respondent has not disputed the aforesaid fact. If that be so then the present application appears to have become infructuous. As of today, no lis is pending before the Trial
