JUSTICE ARVIND SRIVASTAVA ORAL ORDER 01-02-2022 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the informant. The petitioner apprehends his arrest in Barahiya P.S. Case No.184 of 2020 registered under Sections 323, 341, 307, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has committed no offence and has falsely been implicated in the present case due to village politics. It is further submitted that nothing incriminating article has been recovered from possession of the petitioner.

Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for anticipatory bail of the

Patna High Court CR. MISC. No.4908 of 2021(5) dt.01-02-2022 2/2 petitioner by contending that there is specific allegation of firing against the petitioner at the informant on account of which the informant sustained injury. The petitioner has got criminal antecedent.

Therefore, the petitioner does not deserve anticipatory bail.

Having considered the facts aforesaid, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for bail is rejected. Harish/- (Arvind Srivastava, J) U T
