====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 16-12-2024 Heard learned counsel for the petitioners, informant and learned APP for the State.
2. The petitioners are apprehending their arrest in connection with Andhramath P.S. Case No. 34 of 2024 instituted for the offences under Sections 341, 323, 324, 307, 354B, 379, 427, 504, 506/34 of the Indian Penal Code.
3. As per prosecution case, the informant alleged that
Patna High Court CR. MISC. No.64548 of 2024(4) dt.16-12-2024 2/3 the petitioners along with others accused came at her door and started demolishing the construction works. It is further alleged that on the objection raised by the informant, the accused persons abused her and started assaulting her and she suffered injury.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. He submitted that there is a case and counter case between the parties and members of both parties have sustained injury. He further submitted that the allegation levelled against these petitioners are general and omnibus rather the specific allegation of assault is against co-accused persons.
5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the prayer for bail by submitting that the petitioners along with others badly assaulted the informant and her family members of the informant and they also outraged the modesty with them.
6. Considering the aforesaid facts and circumstances of the case, let the petitioners, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with
Patna High Court CR. MISC. No.64548 of 2024(4) dt.16-12-2024 3/3 two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jhanjharpur, Madhubani in connection with Andhramath P.S. Case No. 34 of 2024, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
