A joint petition for compromise has been filed stating that the parties have compromised the case outside the Court and they are not ready to continue with the matrimonial life. They have also agreed to settle the matter on payment of Rs. 1,00,000/-(rupees one lac) as one time settlement. It has been stated that they will start their lives separately and there will be no relation between them. Opposite party no. 2 has agreed to withdraw the case concerned.
In above view of the matter, the provisional bail granted to the petitioner is extended for further four weeks.
Patna High Court Cr.Misc. No.14995 of 2014 (10) dt.03-03-2016 In the meantime, the petitioner will deposit Rs. 1,00,000/- (rupees one lac) before the court below on 30th of March, 2016. Thereafter, the opposite party no. 2 would be at liberty to withdraw the same. After deposit of the money by the petitioner, the court below would pass order making the provisional bail granted to him absolute.
Parties will be at liberty to file application for withdrawal of the case concerned which would be considered by the court below in accordance with law. They would also be at liberty to file a case for divorce on mutual consent which should be disposed of by the court concerned in accordance with law. This application is, thus, disposed of.
