JUSTICE ARUN KUMAR ORAL ORDER 09-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 4.12.2017, seeks bail in Hajipur Town PS Case No. 803 of 2017 registered under Sections 414, 401, 467, 468, 420, 471, 120B/34 of the IPC and Sections 25(1B)A, 25, 11 and 34 of the Arms Act. The allegation in brief is that the police raided hut of the petitioner on the information given by another accused, apprehended many persons from there and from the possession of one of the accused a country made loaded pistol with live cartridge and many instruments for committing theft was also recovered. Learned Counsel for the petitioner submits that the petitioner was not present at the place, no incriminating material was recovered from the possession of the petitioner and the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Bhola Khalifa is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Vaishali at Hajipur in connection with Hajipur Town PS Case No. 803 of 2017.
