The present application has been filed for modification of the order dated 22.5.2009 passed in Cr. Misc. No. 5379 of 2009 to the extent of extending the period of surrender. The petitioners being husband and second wife of the complainant were granted anticipatory bail in connection with Complaint Case No. C847 of 2007.
This court is not inclined to entertain this application after more than six years of the passing of the order. However, let the learned court below consider the prayer for regular bail of the petitioners keeping in view the fact that the petitioners were granted anticipatory bail on merits in case the petitioners surrender within six weeks from today in connection with
Patna High Court Cr.Misc. No.2854 of 2016 (2) dt.19-01-2016 2/2 the aforementioned complaint case pending in the court of learned C.J.M. Kishanganj.
This application is disposed of with the aforesaid observation/direction.
