JUSTICE ANIL KUMAR SINHA ORAL ORDER 01-10-2019 The petitioners apprehend their arrest in connection with Meenapur P. S. Case No. 149 of 2019 registered under Sections 147,149,307,323,324,325,341,354A and 379 of the Indian Penal Code.

Allegation against the petitioners is that petitioner nos. 1, 2 and 5 assaulted the brother of the informant Shatrudhan Sahani by means of rod on his leg and no specific allegation of assault is upon petitioner nos. 3 and 4.

Learned counsel appearing on behalf of the petitioners submits that both parties are neighbours and there is land dispute between them and the allegation of assault by means of

Patna High Court CR. MISC. No.46956 of 2019(3) dt.01-10-2019 2/2 rod is there upon the petitioner nos. 1, 2 and 5 but no injury has been caused to the brother of the informant inasmuch as no injury report has been brought on record.

On the other hand, learned counsel appearing on behalf of the State submits that in the case diary, injuries caused to some other persons are there but injury caused to Shatrudhan Sahani, who was allegedly assaulted by the petitioners is not there. Having regard to the submissions made by the parties and taking into consideration the fact that there is land dispute between the parties and both parties are neighbours, as such I am inclined to grant anticipatory bail to the petitioners. Let the petitioners, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, Muzaffarpur in connection with Meenapur P.S.Case No. 149 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
