JUSTICE PARTHA SARTHY ORAL ORDER 23-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Dighalbank P.S. Case no. 91 of 2020 registered under sections 417, 419, 420, 414 and 34 of the Indian Penal Code.

As per allegation in the FIR, on the vehicle driven by the petitioner being searched, it is stated that 1160 litres of fuel like substance which appeared to be diesel/petrol was seized. No documents were produced by the petitioner. It is submitted by learned counsel for the petitioner that the allegation of recovery is false and incorrect. The petitioner has no criminal antecedent and is in custody since 10.10.2020. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the period in custody together with charge sheet having been submitted in the case, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Dighalbank P.S. Case no. 91 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
