====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 07-08-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 05.02.2019 in a case for the offence registered under Section 392 of the IPC.

The prosecution story, in brief, is that on 14.12.2018, the informant proceeded to 'Satyam Para Medical College, Maripur, Muzaffarpur', from his house. He came at Maniyari for some work. In the meantime, on NH-28 in between Bhikhanpura and Madarsa, two persons sitting on a Motorcycle without number, stopped him and on the point of pistol snatched Rs. 22,000/- and one Mobile. When the Chowkidar came after performing Gasti, miscreants also pointed pistol upon him and

It has been submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. There is no recovery of any incriminating article from possession of the petitioner. The petitioner has not been put on T.I. Parade.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is not named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. Ist Class, Muzaffarpur, in connection with Maniyari P.S. Case No. 357 of 2018.
