JUSTICE PARTHA SARTHY ORAL ORDER 08-04-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Jaynagar P.S. Case no. 17 of 2020 registered against unknown under section 392 of the Indian Penal Code.

As per allegation in the F.I.R., three persons on a motorcycle, on the point of pistol dispossessed the informant of his motorcycle and Rs. 10,000/ in cash.

It is submitted by learned counsel for the petitioner that from the materials on record including the order of the learned Court below it would transpire that in spite of the F.I.R. being registered against unknown and the petitioner being in custody since 10.2.2020 i.e more than one year, although charge

Patna High Court CR. MISC. No.5316 of 2021(2) dt.08-04-2021 2/2 has been framed in the case but the petitioner was not put on T.I. parade. He undertakes to co-operate in the trial. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Jaynagar P.S. Case no. 17 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Madhubani.
